Medvocation is a leading healthcare recruitment marketplace using the innovative job matching technology powered by machine learning and artificial intelligence (AI). Our Services provide the Website for Employers to find high-profiled staff. We hope it helped you to get the right employee!

Thank you for choosing our Website. Our commitment is to put you and your privacy first.

You should read the Medvocation’s Terms & Conditions carefully. Each time you access or use our Medvocation Website (hereinafter referred to as the ‘Website’) you will be deemed to have accepted these Terms & Conditions (hereinafter referred to as ‘the Terms’).

By creating the Medvocation’s Account (hereinafter referred to as the ‘Services’) you agree to be bound by (i) the Terms & Conditions, (ii) our Privacy Policy. If you do not accept and agree to be bound by all of the above mentioned rules, please do not use the Website.

1. Definitions

The following words and expressions have the following meanings unless inconsistent with the context:

The Terms together with our Privacy Policy comprise the ‘the Terms of Use’. The Terms of Use are a framework agreement, the terms of which shall apply to any and each separate Agreement Conditions agreed between the parties.

“We” or "MV" means Medvocation Limited and ‘our’ shall be construed accordingly.

“You” means the Recruiter/ Employer browsing and/or using the Website and ‘your’ shall be construed accordingly.

2. Information on Website

The information and services available on the Website are provided for the sole purpose of recruiters looking for employees in the healthcare industry. You must register to the Website to use our Services, such as posting a Job Offer or sending message to a Candidate.

We actively monitor the Website for job applications or job posts that violate our Terms of Use. If we detect fraudulent activity, we remove such a content from the Website. However, fraudulent job applications or postings can sometimes appear and we urge you to exercise caution in your employee’s search. If you see a suspicious job application, please contact us. If you think you have been the victim of fraud, immediately report the fraud to your local police and contact Medvocation.

Whilst we make every effort to ensure that the information on Website is accurate and complete and to verify legitimacy of Job Posts and Applications, we are not able to check the accuracy or completeness of every information supplied by third party. We do not accept any liability arising from any inaccuracy or omission in any of the information on our Website or any liability in respect of information on the Website supplied by you, any other Website user or any other person.

MV further disclaims all liability for any technical malfunction of the Website, including but not limited to failure of any telephone network or mobile phone equipment, software, failure of email delivery, account login, or any other Services provided by us as a result of technical problems or traffic congestion on the Internet or any third party software or combination thereof, including injury or damage to your mobile device or other hardware or software, related to or resulting from using or downloading any Content in connection with the Website or Services.

3. Your Use of Website

You agree that you shall only use the Website for purposes permitting by law when recruiting medical personnel. In order to use the Website, the Employer must register on the Website and create an Employer’s account. An account may only be opened by an Employer’s on the basis of the appropriate permissions to advertise and fill this role. The required data must be entered accurately and kept updated without delay to ensure a smooth user experience. Upon registration, Medvocation will send the Recruiter confirmation of a registration via email to the address entered during the registration process.

The Employer’s Profile. The Recruiter/ Employer has the option of designing its own Employer’s profile, for example by adding a company’s history or logo. Images or videos of people and other content may only be published on the Website with consent from the relevant persons. Medvocation is authorised to use an Employer’s logo for advertising purposes. Medvocation is also authorised to remove: logos, images and files without prior notice provided there is evidence that the publication of this material on the Website contravenes these terms and conditions, legal provisions, common decency and/or such publication violates third-party rights.

We process information about posted jobs and job applications to connect the right Candidate with a Recruiter/ Employer. We may therefore include information about you in our recruitment database to manage Medvocation’s candidate selection and recruiting processes. If you selected a candidate for a position at Medvocation, information about her/him will also be used to facilitate the hiring process.

You will have access to the selected Jobseeker’s Profile data or contact details if you select to shortlist his/ her profile. In this case, the Jobseeker will also have the access to your data. The first contact with the Jobseeker must take place through the Website. You are expressly prohibited from forwarding Job Postings to professional recruiters or use such Job Postings for any commercial purpose (such as in the operation of a professional recruiting service). You are expressly prohibited from forwarding Job Postings to any group or mass distribution list or otherwise.

Job Posts. By submitting a Job Post to the MV, you are authorizing Medvocation to post such vacancy and match the skills required for each particular job with the most qualified candidates. You shall provide us sufficient details about a vacancy. You must ensure that a job is advertised using the correct categories and locations. You should use a set of Key Skills created by us for each healthcare profession and specialty. This enables us to match the skills required for each particular job with the most suitable candidates. Key skills criteria can include: work experience; skills and knowledge, personality traits, competencies.

Job Posts are valid for six months. Each post can be republished an unlimited number of times. However, we may deactivate your Job Post if you do not activate at least one Candidate within 60 days of that post being published.

You are responsible for the content of a Job Post and will indemnify Medvocation against any claim, loss, liability, expense and/or damage (‘Losses’) in connection therewith. You may not include an email address, URLs or links to website, phone number or any other contact details in a Job Post, a description of duties or a description of the Employer's company. Such unauthorized records will be blocked and deleted by the MV’s service.

You are solely responsible for any information submitted by you to the Website. You must not under any circumstances seek to undermine the security of the Website or any information submitted to or available through it. You are responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trademark or other intellectual property rights of any person in any jurisdiction.

You must not seek to access, alter or delete any information to which you do not have authorized access, seek to overload the system via spamming or flooding, take any action or use any device, routine or software to crash, delay, damage or otherwise interfere with the operation of the Website or attempt to decipher, disassemble or modify any of the software, coding or information comprised in the Website.

4. Security and Passwords

In order to register with the Website you will need to use an e-mail, password and mobile phone number. In order to ensure security, we send the verification code in an SMS message to the number indicated by you in the registration form. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times and not disclosed to any other person. You must notify us immediately if you believe that your password is known to someone else or if it may be used in an unauthorized way. We accept no liability for any unauthorized or improper use or disclosure of any password.

In order to enable the further use of the Website we may send you a verification link in an e-mail. You will also receive information on how to verify the account via ‘My Profile’ section. We have the right to disable any user name, password or other identifier, whether chosen by you or provided by us, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of the Terms or Privacy Policy.

5. Information Submitted by You

We are committed to protecting your Personal Data. The Terms of Use include and incorporate by reference our Privacy Policy, which explains the types of information collected, stored, shared and processed in connection with your profile, how and why we use such information, who we share it with and your legal rights. The Website is directed only to adult people - of age, having a general legal capacity.

When you post a Job Add, you agree to MV performing an automated process of matching a Candidate’s profile to a relevant job including MV’s key skill based matching algorithm and machine learning functionalities.

Moreover we will use information supplied by you to aid the recruitment process and associated administrative functions of this Website. We will process any data which you provide in completing the online registration or Website forms and any further forms, assessments or personal details which you complete or provide to us when using the Website in accordance with relevant data protection legislation. We explain more about your Personal Data in our Privacy Policy.

We and our partners or analytics use tracking technologies such as: cookies, tags and scripts. These technologies are used in analyzing trends, administering the web site, tracking your movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

For the purpose of performing the Website Services, we may cooperate with media partners and host the Website, data relating to the users and Website Services or parts thereof, at further websites and/or on third party hardware. Personal Data will be accessed through the Website database by third parties outside the European Economic Area (collectively ‘EEA’). For instance if you post a vacancy where the employer is based outside of the EEA.

6. Payment

Posting a Job Offer is always free. You only pay for applications (the contact details of the candidates) that you choose to shortlist.

You can buy your payment credits in advance, spending these when you decide to approve an application and begin a conversation with a candidate. Moreover, You can also use your pre-paid credits to ensure that your Job Offer stays at the top of our listings in its category. Credits are valid for 2 years from the time of purchase.

In no event will you be charged for access to any Services unless we obtain your prior agreement to pay such fees. You’ll honor your payment obligations and you are okay with us storing your payment information. You understand that there may be fees and taxes that are added to our prices. We don't guarantee refunds.

7. Electronic Notices

You agree to contact with us electronically. Your affirmative act of registering, using or logging into the Website constitutes your acceptance signature to these Terms. We may provide notices to you electronically (1) via e-mail indicated as Primary in your ‘Contact Details’ section in your Profile or (2) by posting the notice on a device Website designated by us for this purpose. The delivery of any Notice is effective when sent or posted by us, regardless of whether you read the Notice or actually receive delivery. You can withdraw your consent to receive Notices electronically by discontinuing your use of the Service.

8. Interruptions and Omissions in Services

Whilst we try to ensure that the standard of the Website remains high and to maintain the continuity of it, the Internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. We do not accept any liability arising from any such errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate the Website (or any particular part of it) or to provide the service offered on the Website. We may vary the specification of the devices from time to time without notice.

We accept no liability for any loss (whether direct or indirect, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the Website and we hereby exclude any such liability, whether in contract, tort (including for negligence) or otherwise. We hereby exclude all representations, warranties and conditions relating to the Website and your use of it to the maximum extent permitted by law. You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of the Website. You must notify us immediately if anyone makes or threatens to make any claim against you relating to your use of the Website.

9. Intellectual property rights

We grant you a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and nonsublicensable license to access and use the Website. This license is for the sole purpose of letting you use and enjoy the Service’s benefits as intended by Medvocation and permitted by this Agreement. The rights in material on the Website are protected by international copyright, software and trademark laws and you agree to use the Website in a way which does not infringe these rights.

Therefore, you agree not to: copy, modify, transmit, create any derivative works from, make use of, or reproduce in any way any copyrighted material, images, trademarks or other intellectual property, content or proprietary information accessible through the Service without Medvocation’s prior written consent. You may copy material on the Website for your own private or domestic purposes, but no copying for any commercial or business use is permitted.

By submitting Employer’s information you hereby grant to us and our licensees a worldwide, unrestricted, irrevocable, perpetual, non-exclusive, transferable and royalty-free license to use, copy, make, reproduce, display, perform, distribute, sub-license, sell, delete, edit, prepare derivative works from, analyze and otherwise exploit the Employer’s information for the purposes of managing our Website, providing the MV’s Services and operation of our businesses (including by compiling it together with other Employer’s information and anonymizing it to perform statistical analysis for comparison or benchmarking purposes) to the extent permitted by applicable laws.

MV reserves the right to use any Employer’s information (including the content of messages or material sent through or to the Website or MV) to prevent potentially illegal or tortious activities, or any other activities that are detrimental to other users. Medvocation reserves the right to use a variety of methods to detect and block the above anomalous activity and to screen Employer’s information to prevent abuse such as spam or fraud. However, such detection methods are not perfect and false positives may occur. If you use the Website, you agree to MV enforcing the above rules or attempting to prevent spam, fraud, or other anomalous activity.

10. Governing Law and Jurisdiction

The parties shall use their best efforts to settle any dispute, claim, question, or disagreement directly through good-faith negotiations, which shall be a precondition to either party initiating a lawsuit or arbitration.

If the parties cannot resolve the dispute amicably, they accept that the use of the Website and any agreements concluded through the Website are to be governed by and construed in accordance with the laws of Ireland. The courts of the Republic of Ireland are to have exclusive jurisdiction to settle any dispute arising out of or in connection with the use of the Website or any agreement made through the Website.

11. Final terms

To the extent allowed by law, the English language version of the Terms & Conditions is binding and any translations are for convenience only. Headings are for reference purposes and your convenience only and do not form part of the Terms & Conditions.

We are not an employment agency and do not undertake activities that would be considered to be those of agency. We shall not be responsible for and shall have no involvement in any disputes between the Jobseeker and the Employer/ Recruiter. While the MV uses its best endeavors to provide impartial job seeking services, and represents a medium supporting information exchange between employers and employees, we will not be involved in dealings or disputes between Jobseeker and Employer/ Recruiter and the MV shall not be responsible for the quality, security and legitimacy of the recruitment service.

A Employer’s account is assigned to a single user and is non-transferable. You agree not to assign or transfer your rights or obligations under these terms to anyone else without receiving our prior written consent.

12. Changes to Terms & Conditions and Invalidity

The Terms & Conditions may be changed by us at any time. You will be deemed to have accepted the terms and conditions (as amended) when you next use the Website following any amendment.

If any provision of the Terms & Conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
