Terms and Conditions for Job seekers

Medvocation is a leading healthcare recruitment marketplace using the innovative job matching technology powered by machine learning and artificial intelligence (AI). Our Services provide the Application for Jobseekers to look for their ideal job and the Website platform for Employers/ Recruiters to recruit high-profiled staff. We hope it helped you to find the perfect job or the right employee!

You should read the Medvocation’s Terms & Conditions carefully. Each time you access or use our MEDVOCATION Application or Website (hereinafter referred to as the ‘Application’) you will be deemed to have accepted these Terms & Conditions (hereinafter referred to as the ‘the Terms’).
The following words and expressions have the following meanings unless inconsistent with the context:
“We” or "MV" means Medvocation Limited and ‘our’ shall be construed accordingly.
“You” means the Jobseeker browsing and/or using the Application and ‘your’ shall be construed accordingly.
2. Information on Application
The information and services available on the Application are provided for the sole purpose of individuals looking for employment opportunities and career information in the healthcare industry. You must register to the Application to use our Services, such as matching your skills to the healthcare jobs offers and sending messages to the Recruiters/ Employers.
MV platform provides registered users with Job Ads via the ‘Discovery’ tap through android app or iOS app. In ‘My Jobs’ tab you will have all of the jobs divided into three categories: “Saved” jobs list, “Applied” jobs list and “Rejected” jobs list. Those tabs and their content are made up as a result of your choices whilst browsing through the Job ads. You will also have the possibility to archive received/sent chat messages.
Registered user creates the Jobseeker’s ‘Profile’ by filling in data, such as: ‘basic information’, ‘profession’, ‘key skills’ and others. You agree that we may need some information about you or your Personal Data (for example your image, date of birth, key clinical skill, your education, employment history or license numbers), which will be used to match you with the right jobs.
Whilst we make every effort to ensure that the information on Application is accurate and complete and to verify legitimacy of Job ads, some of the information is supplied to us by third parties and we are not able to check the accuracy or completeness of that information. Please note that we do not choose all the questions asked by Employers or decide on the job qualification criteria of Employers. MV is not responsible for the content or accessibility of Job Ads or other material provided by third-party Employers for publication. We do not accept any liability arising from any inaccuracy or omission in any of the information on our Application or any liability in respect of information on the platform supplied by you, any other Application user or any other person.
MV further disclaims all liability for any technical malfunction of the Application, including but not limited to failure of any telephone network or mobile phone equipment, software, failure of email delivery (including attachments), account login, or any other Services provided by us as a result of technical problems or traffic congestion on the Internet or any third party software or combination thereof, including injury or damage to your mobile device or other hardware or software, related to or resulting from using or downloading any Content in connection with the Application or Services.
3. Your Use of Application
Jobseeker agrees that he/she shall only use the Application for lawful purposes: seeking employment or help with career in the healthcare industry. Jobseeker shall not respond to any job vacancy advertisement for any reason other than to apply for the job advertised. Any communications soliciting business for any reason are prohibited.
You are solely responsible for any information submitted by you to the Application. You must not under any circumstances seek to undermine the security of the Application or any information submitted to or available through it. You are responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trademark or other intellectual property rights of any person in any jurisdiction.
You must not seek to access, alter or delete any information to which you do not have authorised access, seek to overload the system via spamming or flooding, take any action or use any device, routine or software to crash, delay, damage or otherwise interfere with the operation of the Application or attempt to decipher, disassemble or modify any of the software, coding or information comprised in the Application.
You can use your ‘Profile’ to apply to job offers that are published on the Application. However, you may not include an email address, URLs or links to website, phone number or any other contact details in the job title or job description. It is also strictly forbidden to indicate this data by Recruiter/ Employer in the job offer, description of duties or description of the Employer's company. Such unauthorized records will be blocked and deleted by the MV’s service.
The Recruiter will have access to Jobseeker’s ‘Profile’ data if he selects to reveal your profile and only then will be able to see the information you provided. In this case, the Jobseeker will also have the access to Recruiter’s/ Employer's data. The first contact with the Recruiter/ Employer must take place through the Platform. If you're suspicious about any private contact you receive related to MV, contact us and our Customer Support Team will investigate.
4. Security and Passwords
In order to register with the Application and to sign in when you visit our Application, you will need to use an e-mail, password and mobile phone number. In order to ensure security, we send the verification code in an SMS message to the number indicated by you in the registration form. You are solely responsible for the security and proper use of your password, which should be kept confidential at all times and not disclosed to any other person. You must notify us immediately if you believe that your password is known to someone else or if it may be used in an unauthorised way. We accept no liability for any unauthorised or improper use or disclosure of any password.
5. Information Submitted by You
We may make available to you certain Job Ads and other job seeking-related content. When you apply for a job, you agree to MV’s performing an automated process of matching your profile to relevant jobs including MV’s skill based matching algorithm and machine learning functionalities.That involves processing of your Personal Data. Such processing is an essential part of the Agreement.
Personal Data may be accessed through the Application database by third parties outside the European Economic Area (collectively ‘EEA’). For instance if you apply for a vacancy where the employer is based outside of the EEA.
Applying to job ads by the Jobseeker is always free, no matter how many individual roles she/he chooses to apply for.
We reserve the right at the future to charge fees for access to some specific features or content. But in no event will you be charged for access to any Services unless we obtain your prior agreement to pay such fees.
7. Electronic Notices
You agree to transact with us electronically. Your affirmative act of registering, using or logging into the Application constitutes your acceptance signature to these Terms. We may provide notices to you electronically (1) via e-mail indicated as Primary in your ‘Contact Details’ section in your Jobseeker’s Profile or (2) by posting the notice on a device application designated by us for this purpose. The delivery of any Notice is effective when sent or posted by us, regardless of whether you read the Notice or actually receive delivery. You can withdraw your consent to receive Notices electronically by discontinuing your use of the Service.
8. Interruptions and Omissions in Services
Whilst we try to ensure that the standard of the Application remains high and to maintain the continuity of it, the Internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. We do not accept any liability arising from any such errors, omissions, interruptions or delays or any ongoing obligation or responsibility to operate the Application (or any particular part of it) or to provide the service offered on the Application. We may vary the specification of the devices from time to time without notice.
We accept no liability for any loss (whether direct or indirect, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the Application and we hereby exclude any such liability, whether in contract, tort (including for negligence) or otherwise. We hereby exclude all representations, warranties and conditions relating to the Application and your use of it to the maximum extent permitted by law. You agree to indemnify us and keep us indemnified against all costs, expenses, claims, losses, liabilities or proceedings arising from use or misuse by you of the Application. You must notify us immediately if anyone makes or threatens to make any claim against you relating to your use of the Application.
9. Intellectual property rights
We grant you a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and nonsublicensable license to access and use the Application. This license is for the sole purpose of letting you use and enjoy the Service’s benefits as intended by Medvocation and permitted by this Agreement. The rights in material on the Application are protected by international copyright, software and trademark laws and you agree to use the Application in a way which does not infringe these rights.
Therefore, you agree not to: copy, modify, transmit, create any derivative works from, make use of, or reproduce in any way any copyrighted material, images, trademarks or other intellectual property, content or proprietary information accessible through the Service without Medvocation’s prior written consent. You may copy material on the Application for your own private or domestic purposes, but no copying for any commercial or business use is permitted.
By submitting Jobseeker’s information you hereby grant to us and our licensees a worldwide, unrestricted, irrevocable, perpetual, non-exclusive, transferable and royalty-free license to use, copy, make, reproduce, display, perform, distribute, sub-license, sell, delete, edit, prepare derivative works from, analyze and otherwise exploit the Jobseeker’s information for the purposes of managing our Application, providing the MV’s Services and operation of our businesses (including by compiling it together with other Jobseeker’s information and anonymizing it to perform statistical analysis for comparison or benchmarking purposes) to the extent permitted by applicable laws.
MV reserves the right to use any Jobseeker’s information (including the content of messages or material sent through or to the platform or MV) to prevent potentially illegal or tortious activities, or any other activities that are detrimental to other users. MEDVOCATION reserves the right to use a variety of methods to detect and block the above anomalous activity and to screen Jobseeker’s information to prevent abuse such as spam or fraud. However, such detection methods are not perfect and false positives may occur. If you use the Application, you agree to MV enforcing the above rules or attempting to prevent spam, fraud, or other anomalous activity.
10. Governing Law and Jurisdiction
The parties shall use their best efforts to settle any dispute, claim, question, or disagreement directly through good-faith negotiations, which shall be a precondition to either party initiating a lawsuit or arbitration.
If the parties cannot resolve the dispute amicably, they accept that the use of the Application and any agreements concluded through the Application are to be governed by and construed in accordance with the laws of Ireland. The courts of the Republic of Ireland are to have exclusive jurisdiction to settle any dispute arising out of or in connection with the use of the Application or any agreement made through the Application.
11. Final terms
To the extent allowed by law, the English language version of the Terms & Conditions is binding and any translations are for convenience only. Headings are for reference purposes and your convenience only and do not form part of the Terms & Conditions.
We are not an employment agency and does not undertake activities that would be considered to be those of agency. We shall not be responsible for and shall have no involvement in any disputes between the Jobseeker’s and the Employer/ Recruiter. While the MV uses its best endeavours to provide impartial job seeking services, and represents a medium supporting information exchange between employers and employees, we will not be involved in dealings or disputes between Jobseeker and Employer/ Recruiter and the MV shall not be responsible for the quality, security and legitimacy of the recruitment service.
The Terms & Conditions are personal to you. You agree not to assign or transfer your rights or obligations under these terms to anyone else without receiving our prior written consent.
12. Changes to Terms & Conditions and Invalidity
The Terms & Conditions may be changed by us at any time. You will be deemed to accept the terms and conditions (as amended) when you next use the Application following any amendment. If any provision of the Terms & Conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
